9. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the website, or participation in any program shall be resolved exclusively through binding arbitration administered in the Commonwealth of Virginia in accordance with the rules of the American Arbitration Association.

The parties agree that arbitration shall be conducted on an individual basis only.

Class actions, collective actions, and representative proceedings are not permitted.

By agreeing to these Terms, you waive the right to a trial by jury and the right to participate in a class action.

Each party shall bear its own attorneys’ fees and costs unless otherwise required by applicable law.

10. Limitation of Damages

To the maximum extent permitted by law, the total liability of BigNet Group LLC for any claim arising from participation in any program or use of this website shall not exceed the amount paid by the participant for the applicable program.

Under no circumstances shall BigNet Group LLC be liable for indirect, incidental, punitive, or consequential damages.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
